AVCAPA Inc. ("AVCAPA," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use the AVCAPA platform at avcapa.com. Please read this policy carefully. 1Information We Collect

Account Information: When you register, we collect your name, email address, shop name, business address, phone number, and license or certification information.

Vehicle and Claim Data: We collect vehicle identification numbers (VINs), damage photos, repair estimates, parts orders, insurance claim numbers, and related appraisal data that you input into the platform.

Customer Data: Through your use of the platform, you may input customer names, contact information, and digital signatures on behalf of your end customers. You are responsible for obtaining appropriate consent from those individuals.

Usage Data: We automatically collect information about how you interact with the platform, including IP addresses, browser type, device identifiers, pages visited, features used, and timestamps.

Payment Information: Billing and payment information is processed by our third-party payment processor and is not stored on AVCAPA's servers.

2How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the AVCAPA platform and its features
  • Process vehicle damage assessments and generate AI-powered repair estimates
  • Facilitate insurance claim submissions to integrated carriers
  • Enable parts procurement through OEM and aftermarket supplier networks
  • Send transactional communications such as claim status updates and parts delivery notifications
  • Improve and develop new platform features through aggregated, de-identified usage analytics
  • Comply with legal obligations and enforce our Terms of Service
  • Detect, prevent, and address fraud, security incidents, or technical issues

3Sharing of Information

Insurance Carriers: Claim data you submit through the platform is transmitted to the insurance carrier you designate. This transmission is governed by your agreement with the carrier and applicable law.

Parts Suppliers: Parts order information is shared with the OEM or aftermarket supplier you select to fulfill your purchase order.

Service Providers: We engage trusted third-party vendors (e.g., cloud hosting, analytics, payment processing) who process data on our behalf under strict confidentiality agreements.

Legal Requirements: We may disclose information when required by law, subpoena, court order, or to protect the rights, property, or safety of AVCAPA, our users, or the public.

Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your personal information to third parties for their marketing purposes.

4Data Retention

We retain your account and claim data for as long as your account is active or as needed to provide services. After account termination, we retain data for up to 7 years to comply with legal, regulatory, and insurance record-keeping requirements, unless a shorter period is required by law.

You may request deletion of your data at any time by contacting us at [email protected]. Note that certain data may be retained where required by law or for legitimate business purposes such as fraud prevention.

5Data Security

We implement industry-standard security measures to protect your information, including:

The AVCAPA platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided personal information, we will delete it promptly.

The platform may contain links to third-party websites or services (e.g., insurance carrier portals, parts supplier sites). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

11International Data Transfers

AVCAPA is operated from the United States. If you access the platform from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the platform, you consent to such transfer.

We may update this Privacy Policy from time to time. We will notify you of material changes via email or in-platform notification at least 14 days before the changes take effect. The "Last updated" date at the top of this policy reflects the most recent revision.
